General Terms and Conditions of the Travel Disputes Commission for Package Travel
Article 1: Scope These general conditions apply to package travel contracts booked from July 1, 2018, as defined by the Law of November 21, 2017, concerning the sale of package travel, linked travel arrangements, and travel services.
Article 2: Information from the Organizer and Retailer Before Conclusion of the Package Travel Contract 2.1 The organizer and the retailer shall provide the traveler, before they are bound by a package travel contract, with the legally required standard information and the following information, if applicable to the package travel: 1° The main characteristics of the travel services:
a) The destination(s), itinerary, and duration of stay, including dates and the number of overnight stays;
b) Means, characteristics, and categories of transport, departure and arrival places, dates and times, duration of travel, and any stopovers and connections; when the exact time is not yet set, the traveler will be informed of the approximate time of departure and return;
c) Location, main characteristics, and category of the accommodation according to the regulations of the destination country;
d) Meals provided;
e) Visits, excursions, or other services included in the total agreed package price;
f) Whether the travel services will be provided to the traveler as part of a group;
g) The language in which other tourist services will be provided;
h) Whether the trip is, in general, suitable for persons with reduced mobility.
2° The total price of the package and, where applicable, any additional costs the traveler may have to bear;
3° Payment terms;
4° The minimum number of persons required for the package and the deadline for possible contract termination if this number is not met;
5° General information on passport and visa requirements, including approximate times for obtaining visas, and health formalities;
6° Information indicating that the traveler may terminate the contract by paying a termination fee;
7° Information on cancellation and assistance insurance.
2.2 The professional ensures that the appropriate standard information form is provided to the traveler.
2.3 The pre-contractual information provided to the traveler is an integral part of the package travel contract and cannot be modified unless agreed upon by both contracting parties.
Article 3: Information from the Traveler 3.1 The person entering into the package travel contract must provide the organizer and retailer with all relevant information that could affect the conclusion of the contract or the smooth conduct of the journey.
3.2 If the traveler provides incorrect information that incurs additional costs for the organizer and/or retailer, these costs may be charged to them.
Article 4: The Package Travel Contract 4.1 At the conclusion of the package travel contract or within a reasonable time thereafter, the organizer, or if there is a retailer, the latter, provides the traveler with a copy or confirmation of the contract on a durable medium, such as an email, paper document, or PDF.
The traveler has the right to request a paper copy if the package travel contract is concluded in the physical and simultaneous presence of the parties.
4.2 The package travel contract or its confirmation includes the entire content of the agreement, which includes all information mentioned in Article 2 and the following: 1° The traveler's special requirements that the organizer has accepted;
2° That the organizer is responsible for the proper performance of all travel services included in the contract and has a duty of assistance;
3° The name of the entity responsible for insolvency protection and its contact information;
4° The name, address, telephone number, and email address of the local representative of the organizer or other contact point through which the traveler can promptly reach the organizer in case of difficulties or to report any lack of conformity;
5° The obligation for the traveler to report any non-conformity observed during the journey;
6° Information allowing direct contact with an unaccompanied minor or the person responsible for the minor at the place of stay;
7° Information on internal complaint handling procedures;
8° Information on the Travel Disputes Commission and the EU online dispute resolution platform;
9° Information on the traveler's right to transfer their contract to another traveler.
4.3 In a timely manner before the start of the package, the organizer shall provide the traveler with: 1° receipts, 2° necessary vouchers and tickets, 3° information on the scheduled departure time and, if applicable, the check-in deadline, the scheduled times of stopovers, connections, and arrival.
Article 5: The Price 5.1 After the conclusion of the package travel contract, prices may only be increased if the contract expressly provides for this possibility. In this case, the package travel contract specifies how price adjustments are calculated. Price increases are only possible if they result directly from changes:
1° In the cost of passenger transport due to fuel costs or other energy sources,
2° In the level of taxes or fees on travel services included in the contract imposed by a third party not directly involved in the package travel performance, including tourist taxes and embarkation or disembarkation fees at ports and airports, or
3° In exchange rates related to the package travel.
If the possibility of a price increase is provided, the traveler is entitled to a price reduction corresponding to any decrease in the above costs.
